  • 부동산 중개업자가 집주인에게 월세를 올려 받으라고 조언해요
        <질문> 한국에는 계약갱신청구권과 전월세 상한제가 있어서 특정 기간 내에는 집주인이 세입자를 마음대로 내보내지도 못하고 전월세를 5% 이상 올리지도 못한다고 알고 있습니다.<사진은 서울의 아파트 단지. 파파야스토리> 그런데 부동산 중개업자가 제가 외국인이니까 잘 모를 것이라고 생각하고 세입자의 계약갱신청구권을 무시하거나 집주인에게 월세를 많이 올리라고 하는 경우가 있습니다. 이렇게 부동산 중개업자에게 속는 것이 너무 억울합니다. 이런 경우 어디에 신고해야 하나요? <답변> 계약갱신청구권은 주택 임대차의 계약 기간(보통 2년) 이후에도 세입자가 해당 건물에서 계속 거주하기를 원할 경우, 1회에 한해 집주인에게 계약의 갱신을 청구할 수 있는 권리를 말합니다. 다만, 집주인이 주택에 직접 들어와 살고자 하는 경우에는 세입자가 계약갱신청구권을 행사할 수 없습니다. 전월세 상한제는 세입자가 계약갱신청구권을 행사해 2년을 더 거주하기로 하는 경우 집주인이 5% 이내에서만 전월세를 올리도록 한 것입니다. 만약 집주인이 계약갱신청구권과 전월세 상한제를 무시하는 행위를 했다면 집주인이 임대사업자인 경우에는 지방자치단체에 신고를 하면 됩니다. 그러면 집주인이 과태료 등의 처벌을 받게 됩니다. 하지만 집주인이 임대사업자가 아닌 경우에는 ‘주택임대차분쟁조정위원회’에 조정을 신청할 수 있습니다. 하지만 이 경우 집주인에게 과태료 등의 처벌이 내리지는 않습니다. 세입자와 집주인 사이에서 주택임대차분쟁조정위원회가 조정을 할 수 있을 뿐입니다. 주택임대차분쟁조정위원회의 조정이 통하지 않을 경우 법원에 민사소송을 제기할 수 있습니다. 한가지, 질문한 분처럼 많은 외국인주민들이 부동산 중개업자가 중간에서 임대료 등을 올리는 행위를 한다고 느끼는 것 같습니다.   하지만 한국에서는 부동산 시장의 특성상 이는 자연스러운 행위라고 할 수 있습니다. 예를 들어 어제 집을 부동산 중개업자에게 매물로 내놓았는데 오늘 매수자가 나타나 집을 바로 사겠다고 하는 경우 부동산 중개업자는 집주인에게 집값을 올리라고 조언할 수 있습니다. 반대로 집을 내놓았는데 여러 달이 지나도록 매수자가 나타나지 않으면 부동산 중개업자가 집주인에게 집값을 내리라고 조언하기도 합니다. 집값이나 월세를 올린 뒤 이득을 집주인이 가져갔다면 아무 문제가 되지 않습니다. 만약 그 이득을 부동산 중개업자가 집주인 모르게 가로챘다면 문제가 됩니다.  그럼에도 집을 보러 온 사람 앞에서 부동산 중개업자가 집주인에게 월세를 올리라고 한다면 이는 대단히 무례한 행위이므로 강하게 항의를 할 수 있습니다. 하지만 그 자체로 처벌 대상이 되지는 않습니다. 외국인주민을 위한 법률상담 ‘파파야스토리 생활법률비자지원센터’ 한국어 031-8001-0211 / 법무법인(유한)민 ‘이주법률지원팀’ 02-3477-5550, 이메일 beobil2002@lawmin.net

  • “한국 경기대학교로 유학 가면 학생 절반이 장학금 받는다”
        한국에서는 학령인구가 줄어들면서 많은 대학들이 정원을 채우지 못해 어려움을 겪고 있다. 이 때문에 각 대학들은 다른 나라에서 더 많은 유학생을 유치하기 위해 노력 중이다.<사진은 경기대 국제교류처 직원들. 파파야스토리> 유학생은 한국 대학 입학의 문이 넓어져 좋지만 어떤 대학을 선택하느냐는 매우 중요한 문제이다. 일부 대학은 정원을 채우기에만 급급해 형편없는 교육과정을 운영하고 있고 이 때문에 학교생활에 적응하지 못한 유학생들이 학교를 이탈하기도 한다. 경기대학교는 1947년에 설립된 한국 수도권의 명문대학이다. 서울과 경기도 수원 2곳에 캠퍼스가 있으며 학부에만 약 12,000명의 학생이 공부를 하고 있다. 현재 경기대학교에 재학 중인 전체 유학생은 한국어 연수 프로그램부터 대학원까지 모두 1355명에 달한다. 유학생이 경기대학교에 입학하기 위해서는 한국어능력시험(토픽) 3급 이상의 실력을 갖춰야 한다. 민소영 경기대학교 국제교류처장<사진 아래 첫번째>은 “경기대학교는 외국인 유학생을 위해 최고의 교육 시스템과 학생 관리 체계를 구축하고 있다”며 “한국에서 생활하는 중도입국 청소년 등 이주배경 학생들이 입학해 공부하는데도 최적의 환경을 갖추고 있다”고 말했다. 다른 대학 압도하는 경기대 경기대학교는 ‘국제교류처’를 통해 유학생들의 학업과 생활을 지원한다. 국제교류처는 유학생들의 기숙사 입소, 출입국 신고, 보험, 해외연수, 복수 학위 등 기본적인 생활을 지원한다. 여기에 유학생들이 학업에 전념할 수 있도록 다양한 노력을 하고 있다. 2020년에는 교육국제화인증을 획득해 우수 외국인 유학생 유치 확대와 국내 학생의 국제화 역량을 입증했다.  경기대는 매년 실시하는 한국 정부의 외국인 유학생 유치 및 관리 실태조사에서 학교 중도탈락률과 언어 능력, 유학생 학업 및 생활지원 등에서 우수한 평가를 받은 것이다. 2020년 1학기부터는 외국인 유학생을 위한 수강신청 체계를 개선해 유학생 전용 영문 수강신청 시스템을 운영하고 있으며 2019년부터는 외국인 입학생 전원을 대상으로 면접 전형을 시행해 우수한 학생들이 경기대에 입학할 수 있도록 수학 능력을 검증하고 있다.  민소영 처장은 “경기대학교 외국인 유학생의 중도탈락률은 6% 미만에 불과해 다른 대학들을 압도한다”며 “단순히 더 많은 유학생을 유치하는 것만이 능사가 아니다. 학업과 일상생활 모든 면에서 유학생이 만족할 수 있도록 다양한 교육 및 지원 프로그램을 운영하고 있다”고 말했다.  경기대학교의 3가지 매력 그렇다면 경기대학교가 외국인 유학생에게 매력적인 진짜 이유는 뭘까? 첫째, 저렴한 학비와 다양한 장학금 제도 때문이다. 경기대학교는 수도권의 다른 대학보다 상대적으로 저렴한 학비를 유지하고 있다. 또한 다양한 유학생 대상 장학제도를 운영하며 유학생들이 학비 걱정 없이 대학을 다닐 수 있도록 지원한다. 예를 들어 외국인 재학생은 석차 34% 이내라면 무조건 장학금을 받는다. 이 장학금은 석차가 높을수록 많아지는데 외국인 재학생 6% 이내의 우수한 성적을 거둔 학생은 수업료 50%와 생활지원비 30%에 해당하는 장학금을 받는다.   신입생도 토픽 실력에 따라 장학금이 지급된다. 토픽 4급 이상이면 수업료 20%와 정착지원금 30%에 해당하는 장학금을 받는다. 토픽 6급이면 무려 수업료 70%에 해당하는 장학금을 받는다. 거기다 유학생활 중 질병과 사고 등의 어려움을 겪는 학생들에게는 특별 장학금을 지급하기도 한다.  둘째, 특별한 학업 및 생활 상담 제도 때문이다. 경기대는 유학생이 수강신청을 하지 않거나 강의에 출석하지 않으면 국제교류처를 통해 상담을 진행한다. 학업에 문제가 있다면 내국인이 참여하는 멘토링 프로그램을 통해 학업을 따라갈 수 있도록 지도한다. 학업 뿐 아니라 일상생활에서 겪는 어려움도 적극적인 상담을 통해 문제 해결을 돕는다. 한국어가 능숙하지 않은 학생은 통역 프로그램을 통해 적극적으로 지원한다. 셋째, 다양한 취업지원 프로그램 때문이다. 기본적으로 유학생은 경기대학교에서 운영하는 33개 이상의 취창업 역량강화 프로그램과 35개 이상의 외부 진로 취업 프로그램에 참여할 수 있다. 유학생들만을 위한 전문 취업프로그램도 운영한다. 2020년에는 외국인 유학생 채용 박람회를 개최했으며 한국에서 입사 면접을 보는 학생들이 어려움을 겪지 않도록 비대면 AI인터뷰 프로그램을 운영하고 있다. 특히 업무협약을 맺은 기업에 졸업생들을 바로 취업시키기도 한다. 경기대 사회복지학과 2학년에 재학 중인 베트남 출신 유학생 얀 씨는 “유학생 장학금 제도가 풍부하고 교수님들이 친절해 학교 다니는 것이 즐겁다”라며 “사회복지 이론을 공부하는 것이 쉽지는 않지만 한국에서 사회복지 분야에 취업하기 위해 열심히 공부하고 있다”고 말했다. 글로벌 인재 양성의 요람 경기대학교는 글로벌 인재 양성과 대학의 국제화를 위해 많은 노력을 기울이고 있다.  특히 학생들이 진정한 글로벌 마인드를 가질 수 있도록 온오프라인 국제화 프로그램을 개발·제공하고 있으며 외국인 유학생들에게는 한국의 실질적인 교육성과를 체험할 수 있도록 교육체계의 지속적인 혁신을 도모하고 있다. 더 나아가 유학생 교육이 선진국과 비교해도 뒤처지지 않도록 교과 및 비교과 과정 그리고 학생상담 등 전사적인 학생관리 체계를 구축하고있다.  민소영 처장은 “경기대는 외국인 유학생 절반 이상이 장학금을 받을 수 있는 우수한 장학 제도를 운영하고 있다”며 “세계 어느 나라에서 오는 유학생도 한국의 선진 학문을 공부하고 더 넓은 세계를 경험하며 글로벌 파워를 갖춘 인재가 될 수 있도록 최선을 다해 지원하겠다”고 말했다. 송하성 기자

  • 경기도, 외국인이 체납한 세금 61억원 징수해
    경기도는 지난해 8월부터 12월 말까지 31개 시군과 합동으로 외국인 세금 체납액 특별정리 기간을 운영한 결과, 4만7203명으로부터 체납액 61억원을 징수했다.<사진은 지난 2016년 수원시외국인복지센터에서 진행된 외국인근로자 이동신문고 상담 장면. 세금 문제 등 다양한 상담이 이뤄진다. 파파야스토리>  이 과정에서 경기도는 전국 최초로 결혼이민자 등 외국어에 능통한 19명을 체납관리단으로 채용해 2만6120명 규모의 실태조사를 벌였고, 공단이 밀집한 시흥·오산에서 통역 상담창구를 운영했다. 이 가운데 오산시에 거주하는 중국인 A씨는 거소지로 발송된 중국어 안내문을 읽고 주민세 등 체납 사실을 뒤늦게 인지했다. 이후 통역상담사 안내 전화를 거쳐 체납액 21만원 전액을 완납했다. 이와 함께 경기도는 외국인 체납의 주요 원인이 언어장벽으로 인한 정보 부족과 납부의식 결여에 있다고 판단하고 자진 납부 유도를 위해 외국인 쉼터 등에 홍보물 2만2000매를 배부했다. 이밖에도 출입국관리사무소와 공조를 통해 체납 외국인에 대한 비자 연장 제한을 강화해 외국인의 납세 의식 향상에 기여하기도 했다. 경기도 전체 외국인 체납자 14만명 중 세금 유형 별로 보면 주민세 체납이 7만7000명(55%), 자동차세 체납이 2만2000명(16%)으로 나타났다.

  • 정부, 인구 감소 충격 대응 위해 외국인 인력 활용 강화한다
        한국 정부가 갈수록 줄어드는 한국의 인구 문제를 해결하기 위해 제4기 인구정책 TF팀(테스크포스)을 출범한다.<홍남기 경제부총리(오른쪽)가 인구정책에 대해 논의하고 있다. 기획재정부> 문제는 출산율의 하락폭과 속도가 예상보다 심각하다는 점이다. 지난해 장래인구추계 결과, 코로나19 충격 등으로 인구구조 변화의 폭과 속도가 커질 전망이다. 총인구 감소 시점이 2029년에서 2021년으로 기존 전망보다 8년 단축됐고, 생산연령인구는 향후 5년 동안 177만명 감소하고, 학령인구는 초등·대학을 시작으로 향후 20년간 40% 이상 줄어들 전망이다.  또, 군 입대가 의무인 한국에서 군대를 갈 수 있는 20대 남성 자원은 저출산 기조 장기화로 향후 5년간 30.8% 급감하고, 소멸고위험지역이 지난해 108개 시군구(47%)에 육박하는 것으로 나타났다. 이에 한국 정부는 저출산 시대에서 한국 경제의 활력을 유지하기 위해 외국인 정책을 변화하기로 했다. 구체적인 방안이 마련된 것은 아니지만 정부가 그 방향을 제시해 이를 소개한다.  제4기 인구정책 TF팀은 외국인력 활용을 강화하기 위해 코로나19 상황에 따른 단기적 외국인력 부족 대응과 향후 변화하는 외국인력 수요 등에 대응하기 위한 중장기 인력수급 파악체계 및 외국인력 활용체계를 구축하기로 했다. 또한 신산업 우수 외국인력 발굴 및 유치, 국내 체류 외국인 증가에 따른 사회통합·정착지원 방안을 논의한다. 정부는 최근까지 우수 외국인재 유입장벽 완화, 다양한 방식의 필요인력 보완방안을 마련하였고, 안정적 정착을 위한 사회통합을 지원하기 위해 노력했다고 스스로 평가하고 있다. 이에 앞으로는 ▲코로나19 상황에 따른 단기적 외국인력 부족 대응 방안을 마련하고 ▲향후 변화하는 외국인력 수요 등에 대응하기 위한 중장기 인력수급 파악체계 및 외국인력 활용체계를 구축하며 ▲신산업 우수 외국인력 발굴 및 유치 방안(비자·세제·정주여건 등)을 적극 추진하기로 했다. 또한 ▲국내 체류 외국인 증가에 따른 사회통합·정착지원 방안을 마련하기로 했다. 제4기 인구정책 TF팀의 이러한 방안은 출산 대책, 여성 인력 방안, 노년 인력 활용 방안 등과 함께 추진되며 각 분야별 전략과 세부 대책은 7월 이후부터 순차적으로 발표할 계획이다. 정부 관계자는 “전체 인구에서 외국인이 차지하는 비중은 3.3%으로 OECD 회원국 중 낮은 편에 속하나 증가속도는 매우 빠른 상황”이라며 “외국인 정책을 포함해 인구정책을 효율적으로 추진하기 위해 최선을 다하겠다”고 말했다. 송하성 기자

  • 한국 정부, 단기체류 외국인 숙박신고제도 운영
      외국인 숙박신고제는 감염병 또는 테러 경보의 발령 시 단기체류 자격을 가진 외국인이 숙박업소에 머무는 경우 숙박업소가 이 사실을 법무부에 신고하도록 한 제도이다. 국내에 91일 이상 장기 체류하는 외국인은 외국인등록(또는 외국국적동포 거소신고) 단계에서 체류지 입증자료를 제출하기 때문에 소재를 파악할 수 있다. 숙박업소는 ▲<감염병의 예방 및 관리에 관한 법률>에 따른 감염병 ‘관심’ 이상 위기경보 발령 시 ▲<국민보호와 공공안전을 위한 테러방지법>에 따른 ‘주의’ 이상 위기경보 발령 시 단기체류 외국인의 숙박 사실을 법무부 외국인 숙박신고 사이트( https://www.k-eta.go.kr/trds/index.do)에 신고해야 한다. 단기체류 외국인은 숙박업자에게 여권 또는 여행증명서를 제공해야 하며 숙박업소는 외국인이 숙박한 때 또는 위기경보가 발령된 때로부터 12시간 내에 투숙 중인 단기체류 외국인의 정보를 신고해야 한다. 위반 시 50만 원 이하의 과태료가 부과된다. 송하성 기자

  • 외국인 보호소의 무기한 구금 개정 서명운동 진행
        이주민들의 인권을 보호하는 법률활동을 주로 해온 ‘공익법센터 어필’이 외국인보호소에 수용된 외국인을 사실상 무기한 구금할 수 있도록 한 ‘출입국관리법 제63조 1항’ 개정을 요구하는 서명운동을 시작했다.<사진=공익법센터 어필> 어필은 홈페이지에 공개한 캠페인 알림을 통해 “한국에는 그런 곳이 있습니다. 사람들을 마음대로 가두고 심지어 죽음에 이르게 하는... 단지 외국인이라는 이유로 사람을 쉽게, 무한정 가두는 외국인 보호소, 제도적 개선이 필요합니다”라며 출입국관리법 제63조 1항을 수정하도록 서명에 동참해 줄 것을 촉구했다. 현행 출입국관리법 제63조 1항은 강제퇴거명령을 받은 외국인이 여권이 없거나 교통편을 확보하지 못해 곧바로 국외로 나가지 못할 경우 송환이 가능할 때까지 보호시설에 보호할 수 있다고 규정했다. 이 조항에는 기간이 명시돼 있지 않아 사실상 무기한 구금이 가능하다. 이 때문에 어필은 보호소에서 외국인에 대한 인권 침해가 가능하다고 보고 있다. 이미 유엔난민기구(UNHCR)와 국가인권위원회는 해당 조항을 개선할 것을 권고한 바 있다. 하지만 헌법재판소는 해당 조항에 대해 이미 세 차례나 헌법에 어긋나지 않는다는 결정을 내렸다. 강제퇴거 대상자는 자진 출국함으로써 언제든지 보호 상태를 벗어날 수 있으므로 외국인의 출입국과 체류를 적절하게 통제하고 조정해 국가의 안전보장·질서유지 및 공공복리를 도모하기 위해 필요한 조항이라는 입장이다. 어필 관계자는 “외국인보호소는 ‘보호소’라는 이름으로 불리지만 사실상 교도소와 완전히 동일한 방식으로 운영되고 있다”며 “구금 기간 동안 대부분의 외국인이 극심한 스트레스와 정신적 육체적 질환에 시달린다”고 지적했다. 특히, 김세진 어필 변호사는 “1만명 서명 목표 달성 후 구금 상한 기간을 명시하는 개정안을 정부에 요청할 계획”이라며 “동시에 미성년 이주아동과, 도주 우려가 없거나 치료를 요하는 외국인 등 구금이 반드시 필요 없는 외국인에 대한 수용 여부를 합리적으로 판단하고, 보호소 내 인권 침해 방지를 위해 외부 감시 절차 등을 요구하겠다”고 말한 것으로 알려졌다. 지난해 12월 말 시작된 서명운동에는 현재 1천800여 명이 참여했다. 서명 링크https://www.campaigns.kr/campaigns/560 송하성 기자

  • 韩国政府6月24日起向低收入层发放最高100万韩元的紧急生活支援金
    韩国政府计划从6月24日起以227万户低收入阶层为对象发放紧急生活支援金。<图片来源:保健福利部> 韩国保健福利部表示,此次低收入阶层紧急生活支援金将发放给约179万户基础生活保障领取者和约48万户法定次上位阶层和接受儿童养育费支援的单亲家庭。 登记为基础生活领取者和次上位阶层的多文化家庭也将获得支援金。 紧急生活支援金的发放标准为:生计、医疗补助领取家庭——1人家庭最高40万韩元、2人家庭65万韩元、3人家庭83万韩元、4人家庭100万韩元、5人家庭116万韩元、6人家庭131万韩元、7人家庭145万韩元。 居住、教育补助领取家庭、法定次上位阶层和单亲家庭将获得1人家庭30万韩元、2人49万韩元、3人62万韩元、4人75万韩元、5人87万韩元、6人98万韩元、7人家庭109万韩元。 符合领取条件的居民无需另行申请,直接访问居住地邑面洞居民中心即可领取预付型银行卡或地区货币卡。 紧急生活支援金一次性发放,支援金需要在今年内全部用完。 以银行卡形式支付是为了限制部分行业的使用以及方便事后管理,养老设施内领取者等对象将以补助金(现金)的形式发放。 各地方城市允许使用紧急生活支援金的范围各有不同。 釜山、大邱、世宗等地方自治团体将从6月24日起发放支援金,首尔、大田、蔚山、济州等地区将从6月27日起发放,其余地区也将在6月内发放。 이지은记者

    Last year, the Hwaseong Foreigner Shelter, which caused a controversy over human rights violations by tying the limbs of Moroccan foreigner behind his/her back, is changing into a human rights-friendly facility. Hwaseong Foreigner Shelter was a foreigner protection facility that detained foreigners who were about to leave the country forcibly, but it is being transformed into an “alternative foreigner protection facility” that guarantees the inmates’ right to move and autonomy. The Ministry of Justice has been implementing human rights-friendly facilities improvement, etc. in the women's protection wing of the Hwaseong Foreigner Shelter since April 18. The iron bars dividing the detention area were removed and the playground was opened during the day to allow the inmates to move freely within the facility. In fact, on May 23rd, members of the Special Committee on Refugee Immigrants of the Korean Bar Association visited the Hwaseong Shelter for women foreigners and confirmed this fact.   • Real estate agent advises landlord to raise monthly rent
      In Korea, there is a right to request a renewal of the contract and a cheonsei monthly rent cap, so I am aware that the landlord cannot release the tenant at will or raise the cheonsei and monthly rent more than 5% within a certain period. However, there are cases when real estate agents know that I am a foreigner and think that I would not know well. So they either ignore the tenant's right to apply for contract renewal or tell the landlord to raise the monthly rent a lot. It is very unfortunate to be deceived by a real estate agent like this. Where should I report this? The right to request a renewal of the contract refers to the right to request the landlord to renew the contract only once if the tenant wants to continue living in the building after the contract period (usually two years) of the housing lease. However, if the landlord wants to live in that house, the tenant cannot exercise the right to apply for contract renewal. The cheonsei monthly rent cap allows the landlord to raise the cheonsei monthly rent by only 5% if the tenant exercises the right to renew the contract and decides to live for two more years.
